You have rights. And we know how to enforce them.

If you are being sued by Richard D. Sokoloff for MEDICAL BILLS or a MEDICAL DEBT, there are some things you should know.

Debt collection litigation is a complicated matter with many laws, rules, and regulations that debt collectors like Richard D. Sokoloff must follow. If debt collectors fail to follow the rules and the law, their claims against you may be dismissed, in which case you may be able to have them removed from your credit report.

We fight to have your debts dismissed permanently or reduced significantly.

In New York State, there are different rules when it comes to Medical Debt Collection. For example:

New York state has a medical debt protection law (N.Y. Pub. Health Law § 2807-k[9-a]) that prohibits discriminatory pricing by hospitals that receive state charity care funding. This law prohibits these hospitals from charging uninsured patients whose income is under 300% of the federal poverty level more than what the hospitals receive from Medicare, Medicaid, or the highest volume payer for services performed in that hospital. If your medical debt provider qualifies, you may be able to have the amount of your medical bill reduced significantly.

N.Y. Pub. Health Law § 2807-k[9-a][d] – Consumers with income under the federal poverty threshold can only be required to pay a nominal amount, while consumers with incomes of 100% to 150% of poverty can be required to pay up to 20% of the amount paid by insurers for hospital services. In addition, hospitals are required to provide for payment plans, for which the monthly medical bill payment cannot exceed 10% of the patient’s gross monthly income and for which interest is limited to the rate on a ninety-day Treasury bill plus 0.5%.

Are you being HARASSED by a debt collector over an alleged medical debt?

If So, You May Be Entitled to Recover Money Damages.

  • Did a debt collector sue you in the wrong court?

  • Did a bill collector threaten to sue you on a medical bill that is past the statute of limitations?

Debt collector harassment is illegal, and Federal Law allows you to recover damages and attorney’s fees against harassing debt collectors. If you believe you have been illegally harassed by a debt collector, we will take your case at no cost to you and get you the damages you deserve.
