Certain federal and state laws – like those protecting consumers from unfair business acts & practices, debt harassment, robocalls, and defective cars – are rarely enforced by the government. Instead, the law encourages attorneys like us to represent consumers by forcing companies that break the law to pay your attorney’s fees. We’re either paid by the companies that have violated your rights, or by a percentage of the cash settlement that we negotiate. That means many of our clients never pay a dime out of pocket.
So, for example, if a court finds that a debt collector violated the Fair Debt Collection Practices Act (FDCPA) by harassing you, the debt collection agency pays you a settlement, and they also pay your attorney’s fees. For consumers who are being sued for a debt, unfortunately there’s no mechanism in the law to provide you with a free legal defense. Defending a lawsuit requires a lot of work, and the traditional lawyer hourly-billing method makes most lawyers unaffordable for consumers trying to defend themselves from debt collection lawsuits. This is where we’ve decided to break from tradition. Under our philosophy that affordable legal representation should be available to everyone, we limit our attorney’s fees to a low monthly fixed amount for debt defense matters.
Our Experience and Knowledge
Mrs. Murtha has over a decade of experience assisting consumers with many types of legal issues. Her legal career began as a bank attorney for several years with a large real estate firm. She joined a large litigation firm as a trial associate, specializing in No-Fault litigation and personal injury matters, where she tried hundreds of cases, representing both individuals and commercial clients, including major insurance companies in both state and federal court. In the late 2000s, she switched her focus to consumer protection issues, primarily on defending consumers from abusive debt collectors and suing businesses for deceptive and fraudulent acts and practices. She has vast experience representing clients in New York State District, Supreme, Appellate and Federal Courts, and is admitted to practice law in all the Courts of the State of New York, as well as the United States District Court for both the Eastern and Southern Districts of New York, as well as the United States Court of Appeals for the Second Circuit.
In addition to her litigation experience, she has presented many seminars and training events to consumers across Long Island, New York regarding how to protect your assets from debt collectors, how to defend yourself from collection lawsuits, and other general topics such as the right to privacy in New York, and copyright defense & photographer’s rights.
